Terms of Service

    Last updated: 29 August 2026

These Terms of Service ("Terms") govern your access to and use of the website located at belowhammer.com and any related content, data, and features (together, the "Service"), operated by Below Hammer ("BelowHammer", "we", "us", or "our"). Please read them carefully.

    1. Acceptance of terms

By accessing or using the Service you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you must not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

    2. Description of the service

BelowHammer is an independent UK property auction intelligence platform. We collect and display publicly available property auction listing data from third-party sources (including, but not limited to, Auction House UK, Auction House London, and BTG Eddisons) and present statistical valuation estimates and indicators derived from public data such as HM Land Registry House Price Index data. We are not an auction house, estate agent, broker, surveyor, or financial adviser. We do not sell property, take fees from sellers, or earn commission on completed sales.

    3. Use of the website and data

The Service, including all listing data, valuations, risk scores, and other estimates, is provided for general informational purposes only. It does not constitute financial, investment, legal, tax, surveying, or professional advice of any kind, and must not be relied upon as such. Valuations and scores are statistical estimates, not a survey or formal valuation.

You are solely responsible for your own decisions. Before bidding on or purchasing any property you must carry out your own due diligence, read the full legal pack, obtain independent professional advice where appropriate, and inspect the property in person. You agree to use the Service only for lawful purposes and not to: (a) scrape, harvest, or systematically extract data from the Service except as expressly permitted; (b) interfere with or disrupt the integrity or performance of the Service; (c) attempt to gain unauthorised access to any part of the Service or its underlying systems; or (d) use the Service in any way that infringes the rights of others or breaches applicable law.

    4. Accuracy of auction listing data

Auction listing data displayed on the Service is sourced from third parties and public records. It is aggregated automatically and may be incomplete, out of date, or inaccurate. Listings, guide prices, lot details, auction dates, and availability are set and changed by the relevant auction houses and sellers, not by us, and are subject to change or withdrawal at any time without notice.

We do not warrant or guarantee the accuracy, completeness, timeliness, or availability of any listing data, valuation, or estimate on the Service. You must verify all information directly with the relevant auction house before acting on it. We are not responsible for the content, accuracy, or practices of any third-party source or website.

    5. Intellectual property

The Service and its original content, features, design, branding, and functionality are owned by BelowHammer and are protected by copyright, trademark, and other applicable laws. Underlying property listing data and public datasets remain the property of their respective owners and sources. You may view and use the Service for your own personal, non-commercial purposes, but you may not copy, reproduce, republish, resell, or redistribute any part of the Service without our prior written permission, except where permitted by law.

    6. Third-party integrations and published content

We may use third-party platforms and integrations — including social media services and other publishing channels — to promote and distribute content associated with the Service, such as summaries of auction listings. Your use of any third-party platform is governed by that platform's own terms and privacy policies, over which we have no control. We are not responsible for third-party platforms or for how they process any content or data. Content we publish on such platforms is provided on the same informational, non-advice basis set out in these Terms.

    7. Limitation of liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. To the maximum extent permitted by law, BelowHammer will not be liable for any loss or damage — including, without limitation, any direct, indirect, incidental, consequential, or special loss, loss of profit, loss of opportunity, or losses arising from any purchase or bidding decision — arising out of or in connection with your use of, or reliance on, the Service or any data, valuation, or estimate provided through it.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

    8. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Changes take effect when posted on this page, and your continued use of the Service after any change constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

    9. Governing law

These Terms and any dispute or claim arising out of or in connection with them or the Service are governed by and construed in accordance with the laws of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales.
